PROCEDURE FOR THE AWARD OF CONCESSION FOR THE CABLE CAR KOTOR - CETINJE - PUBLIC INVITATION FOR PRE-QUALIFICATION
The Ministry of Sustainable Development and Tourism of Montenegro (hereinafter: Ministry) as the competent authority pursuant to the Law on Concessions and on behalf of the Government of Montenegro as the Grantor, hereby invites pre-qualification applications (hereinafter: Pre-qualification Applications) from prospective bidders (hereinafter: Applicants) for the award of concession for the construction and operation of a cable car from Kotor to Cetinje, which passes over the Mountain Lovcen, one of the national parks in Montenegro, for Design, Build, Finance, Operate, Transfer (DBFOT) basis (hereinafter: Project). In order to consider the relevant aspects, a Feasibility Study and Revised Preliminary Design Project have been developed for all phases, except for machine installations, cableway stations and pavement structures for which conceptual designs have been made. The Cable Car will connect the Municipality of Kotor and the Old Royal Capital of Cetinje, passing through the National Park Lovcen. The entire route will be divided in three sections, with four stations: Dub, Kuk, Ivanova Korita and Cetinje. The total length of the route is about 15 km.
The concession for the Project will be awarded through a transparent, open, and competitive international two-stage procedure, in accordance with the Montenegrin Law on Concessions (hereinafter: Tender).
1. The documentation containing details on the pre-qualification procedure (hereinafter: Pre-qualification Document) may be obtained in the premises of the Ministry or submitted electronically in accordance with the request. Entities which take over the Pre-qualification Document are obliged to provide a Request for Pre-qualification Document, indicating identification data, contact telephone and e-mail address in order to be registered and included in the questions and answers distribution list and notifications distribution list during the Tender.
2. In order to qualify for participation in the second stage of the Tender, the Applicants must satisfy the following pre-qualification criteria, as further elaborated in the Pre-qualification Document:
• the average of the Applicant’s Profit (i.e. weighted average in case of consortium) for the last three (3) fiscal years has to be positive, i.e. greater than zero;
• the average Applicant’s Equity (i.e. weighted average in case of consortium) for the last three (3) fiscal years has to be greater than EUR 5 million;
• the average Turnover of the Applicant (i.e. cumulative average in case of consortium), for the last three (3) fiscal years has to be greater than EUR 40 million;
• the Applicant (or, if the Applicant is a Consortium, a member of the Consortium) has, or has entered into a preliminary agreement on participation in realization of the Project with an entity that has experience in constructing and equipping at least one operational cable car system (with length of at least 2 km) that was completed in the last five (5) years;
• The Applicant (or, if the Applicant is a Consortium, a member of the Consortium) has experience in projects of concession/PPP scheme, as a sponsor or as a concessionaire, with a minimum construction costs for the construction of infrastructural objects of the concession of at least EUR 15 million in the last five (5) years.
3. The documents required in order to evidence fulfillment of the pre-qualification criteria are determined in the Pre-qualification Document.
4. In the event that the Applicant is a consortium, it must fulfill the pre-qualification criteria set forth in Paragraph 2 and meet additional requirements set forth in the Pre-qualification Document and submit additional documents specifically required for consortiums as Applicants.
5. Pre-qualification Applications must be delivered by 12.00 hours by local Podgorica time on September 5th, 2017 to the following address: Ministry of Sustainable Development and Tourism of Montenegro, IV Proleterske brigade 19, 81000 Podgorica, Montenegro.
6. The submitted Pre-qualification Applications will be opened by the tender commission appointed by the Ministry (hereinafter: Tender Commission) on the same day at 12.30 hours by local Podgorica time, in the premises of the Ministry, IV Proleterske brigade 19, 81000 Podgorica, Montenegro, in accordance with the Decree on Closer Method of Conduct of Public Tender Procedure for the Award of Concession in the Open and Two-stage Procedure ("Official Gazette of Montenegro" no. 67/09) (hereinafter “Decree”) and the Pre-qualification Document.
7. The Pre-qualification Applications will be evaluated by the Tender Commission, in accordance with the procedure established in the Decree and the Pre-qualification Document. It is expected that the Tender Commission will finalize its evaluation within 10 days from the date of the opening of the Pre-qualification Applications.
8. Applicants who meet the requirements and criteria of the pre-qualification process shall be deemed as applicants qualified for participation in the second stage of the Tender (hereinafter: Qualified Applicants).
9. Qualified Applicants will be invited to submit bids for the Project.
10. Qualified Applicants will be able to purchase the tender documentation.
11. The Applicant shall bear all its costs and expenses associated with its participation in the Tender, including, without limitation, all costs and expenses associated with the preparation and submission of its Pre-qualification Application.
12. In any event, the Applicants, the Qualified Applicants, including the first ranked Qualified Applicant shall not be entitled to reimbursement or compensation for any costs and expenses related to its participation in the Tender, even if the Ministry and/or the Government of Montenegro cancels the Tender or otherwise desist(s) from awarding the concession for the Project.
13. Any request for additional information and/or questions relating to the Pre-qualification Document shall be sent to the Ministry by electronic mail at the addresses milena.lukic@mrt.gov.me and sonja.becanovic@mrt.gov.me until 12.00 hours no later than 7 days before the deadline for submission of prequalification applications.
