Ministry of Public Administration to hold additional public consultations on key regulations of importance for work of NGOs

Podgorica, Montenegro (23 March 2018) -- In order to further strengthen the institutional mechanisms of cooperation between the Government and NGOs, the Ministry of Public Administration started the process of additional public consultations for two key regulations in this area, namely the Draft Regulation on the election of NGO representatives to the working bodies of the state administration and the holding of a public debate when drafting laws and strategies, and the Draft Decisions on the Council for cooperation between state administration and NGOs.
Regardless of the fact that we are not bound by the law, we found it natural and useful to hold additional 40-day public consultations on such important regulations. We believe this is the right way to come up with, through an open partnership approach and constructive dialogue, better systemic solutions and high-quality basis for more productive relations between the Government and NGOs.
The two pieces of legislation contain important novelties in relation to valid solutions in terms of strengthening transparency, accountability and involvement of the the civil sector and citizens in the process of creating and implementing public policies.
Namely, the Draft Regulation provides for the obligation to hold public consultations when developing strategies, and not only laws, as it is now, and improves the criteria for the selection of representatives of NGOs to the working bodies. Furthermore, it also allows representatives of NGOs who are not Montenegrin citizens, but are residents of Montenegro, to be members of the state administration’s working bodies. Under the regulation, law-makers will be obligated to publish the Regulatory Impact Assessment (RIA) along with the draft law that will be the subject of public debates.
The decision on the Council for Cooperation between state administration bodies and NGOs will streamline the structure of the current Council and clarify its mandate and competence in order to improve the quality and effects of its activities in relation to the existing model of the Council for NGOs Development.
A representative of the NGO took part in developing the draft regulation, and a public debate took place on the solutions set out in this regulation, whereas NGO representatives in that body were consulted on the method of transformation of the existing NGO Development Council. Given the importance of both documents, we have decided to carry out further 40-day consultations on the content of both draft regulations in order to make sure that all interested civil society organisations have the opportunity to make their contribution and reach together better systemic solutions for productive cooperation between the Government and NGOs for the benefit of the citizens of Montenegro.
