Podgorica. Montenegro (1 November 2018) -- At today's session, the Montenegrin Cabinet, within the framework of regular reporting on fulfiling obligations from the European agenda, passed the information on the plan for fulfiling the final criteria for temporarily closing negotiations in the following chapters: 2 - Freedom of movement for workers, 4 - Freedom of movement of capital, 5 - Public procurement, 6 - Commercial law, 7 - Intellectual property law, 10 - Information society and media, 15 - Energy, 31 - Foreign, security and defence policy. The discussion emphasised that, given the fact that Montenegro has entered a more demanding phase of closing the chapter, the obligations of the negotiation process need to become top priorities of the competent authorities in order to meet the set deadlines.
Today's session passed the Draft Law Amending the Law on Border Control. The passing of the Law is primarily necessary for the harmonisation of border control tasks with the legal acquis of European legislation, bearing in mind that Montenegro is one of the candidates for EU membership and that after joining the European Union, it will be part of the Schengen area. The proposed provisions will improve the conduct of border control, which will contribute to better security at the Montenegrin borders, and therefore to better security of Montenegro in general.
The Cabinet also passed the Draft Law Amending the Law on Public Bailiffs. In addition to the law, public bailiffs will be obliged to submit reports on revenues and assets to the Anti-Corruption Agency, in accordance with the law regulating the prevention of corruption. .
The Government passed the Regulation on vocational training and training of civil servants and state employees. The Public Administration Reform Strategy 2016-2020 in the area of vocational training and training of civil servants and state employees indicates that it is necessary to strengthen the system of responsibility in relation to the conducting of trainings, as well as strengthening the strategic planning of training at the level of the body. The regulation introduces uniform human resources management standards, which will significantly improve the civil service system, both through improving the work of human resource units and the overall work of the body.
The Government considered and adopted the Information on the conclusion of the Development Cooperation Programme between the Government of Montenegro and the Government of Slovenia for the period 2018-2019. The discussion stressed that Slovenia is one of the most active donors in Montenegro, and at the same time an example of the coherence of development support with the strategic priorities of the recipient country. During the decade of development cooperation, the Republic of Slovenia provided support to Montenegro in the amount of approximately ten million and seven hundred thousand euros, mostly in the field of environmental protection, energy, tourism and education, as well as expert technical assistance in the process of European and Euro-Atlantic integration. In order to continue the successful development cooperation between the two countries, the Government accepted the text of the Programme for the period 2018-2019.
Today's session passed the Information on the conclusion of the Technical Arrangement between the Ministry of Defence of Montenegro and the Ministry of Defence of Slovenia on logistical support for participation in the NATO enhanced Forward Presence (eFP) in Latvia and the signing of the Declaration on the Transfer of Rights to Use Connection Devices for the Need for Participation in the NATO enhanced Forward Presence (eFP) in Latvia. Montenegro, as a full member of NATO, is committed to contributing to the strengthening of the collective defence system. Under the Decision of the Defence and Security Council, with a view to preserving stability on the eastern borders of the Alliance, a reconnaissance division of the Armed Forces of Montenegro, with a size of up to nine members, will be deployed in the combat group in Latvia, within Intelligence and Reconnaissance Company of the Armed Forces of Slovenia, under the Canadian command. In addition, the Armed Forces of Montenegro will deploy one staff officer in the combat group in Latvia.
The Government adopted the Information on the conclusion of the Agreement on Mortgages and the Agreement on Pledged Accounts between Montenegro - the Ministry of Finance and the Montenegrin Electricity Transmission System (CGES), in connection with the Guarantee Agreement with KfW Bank for the needs of the realisation of the project "Montenegrin Coast: Luštica Region Development." By concluding these agreements, collateral for the state guarantee will be provided. A loan of 20 million euros will be used for investing in the energy efficiency of facilities and infrastructure in the transmission system. The issuance of the state guarantee for the implementation of the project, with the provision of collateral, is envisaged by the Budget Law for 2018.
The Government adopted the Information on the organisation of the Games of the Small States of Europe in 2019, with a proposal for further financial support. The Games of the Small States of Europe are a multi-sport competition, sponsored by the European Olympic Movement since 1985. The organisation of the Games in 2019 was awarded to Montenegro, and the Montenegrin Olympic Committee is in charge of the implementation. It was pointed out that Montenegro will be organising such a big multi-sport event for the first time, which will bring together about 200 participants.The Ministry of Sports was tasked to pay EUR 305,000 to the Montenegrin Olympic Committee in support of the funding of the Games.
The Cabinet adopted the Information on follow-up coordinated evaluation of higher education institutions in Montenegro, with a report developed by the European University Association. Within the project "Higher Education and Research for Innovation and Competitiveness," implemented by the Ministry of Education and the Ministry of Science, which is financed from the World Bank's loan, a subsequent external evaluation of higher education institutions in Montenegro was conducted. The evaluation of nine institutions was carried out by a team of independent international experts, hired by the European University Association (EUA), within the Institutional Evaluation Programme (IEP). Previous evaluation was conducted in 2013/2014. In accordance with the applicable procedure, the EUA-IEP has produced nine individual reports for each institution and one summarised report on the higher education system in Montenegro, with recommendations at national and institutional levels. According to the reports,compared to 2014, there are significant and positive changes in the legal and financial framework, as well as with regard to the institutions themselves, and everything that has been done over the past four years can be considered as the first but important step in the long process of reforming the higher education system .
Regarding request for the exemption of Minister of Economy Dragica Sekulić, the President of the Tender Commission in the process of land lease for the construction of a solar power plant on the Briska Gora location, the Government considers that this is a flagrant abuse of the exemption institution.
The request submitted without prior decision on the selection of the bidder was rejected not only as unfounded, but also as an inappropriate attempt to pressure the Tender Commission or the Government.
Convinced that following such a request stands the intention of preventing the Government from pursuing economic policy and protecting the national interest, we are determined to prevent the use of private capital as an instrument of obstruction of the state and its institutions, today's Cabinet session concluded.
