PM Marković on decision of Constitutional Court: Confirmation that institutions are credible, capable, autonomous and ready to enforce laws

Prime Minister Duško Marković said that today's decision of the Constitutional Court confirms that institutions are credible, capable, autonomous and ready to enforce laws.

The Constitutional Court today initiated the procedure for reviewing the constitutionality of the provisions of the Criminal Procedure Code and temporarily suspended the execution of the decisions of the Higher and Appellate Courts to which Nebojša Medojević and Milan Knežević were sent to prison pursuant to Article 119 of the CPC.

"Today's decision of the Constitutional Court confirms the legality of the work of the Higher and Appellate Courts and the legality of their decisions. Therefore, the views of the Democratic Front and their attorneys, that the decision was illegal fell into the water. On the basis of a constitutional complaint, the Constitutional Court initiated the procedure for assessing the constitutionality of Article 119 of the CPC and we will see how this procedure will end. Perhaps the constitutionality of paragraph 2 of article 119 may or may not be confirmed. Therefore, today's decision of the Constitutional Court gave full legitimacy to ordinary courts, the work of the Special State Prosecutor's Office and confirmed the credibility of the Constitutional Court "- PM Marković said answering on journalists’ questions after the Prime Minister’s Question session.

The Prime Minister recalled the charges of the opposition that the Constitutional Court is the puppet of the government and politics, and he pointed out that today's decision of the Constitutional Court confirms that institutions are credible, capable, autonomous and ready to enforce laws.

When asked about possible liability, if any legal solution is declared unconstitutional, Prime Minister Duško Marković noted that there is no such responsibility, and that it is the right of individuals and entities in the society to initiate constitutional proceedings.

"They said that the High Court acted unlawfully, you saw that the Constitutional Court said it was not. They said that the Appellate Court rendered an unlawful decision, the Constitutional Court confirmed that the decision of the Appellate Court was lawful. That the special prosecutor acted in accordance with the authorities of the CPC, that is, Article 119 - lawfully, that is" - the Prime Minister emphasised.

But at the same time the Constitutional Court accepted the claims of the submitter of constitutional complaint to initiate the procedure of assessing the constitutionality of that article, he added.
