PM Marković: Despite lawful, timely, conscientious conduct of police in corruption case in Ministry of Sustainable Development, Tourism, there was no effective prosecution's response

Podgorica, Montenegro (1 November 2019) -- Prime Minister Duško Marković addressed the Prosecutorial Council with a letter regarding a corruption case in the Spatial and Building Inspection of the Ministry of Sustainable Development and Tourism, stating that despite the lawful, timely and conscientious conduct of the Police, there was no effective response by the Prosecutor's Office.
The Prime Minister also wrote that after discovering the apparent existence of corruption, he, as the Prime Minister, requested detailed information on the conduct of the Police Authority in this and other cases related to unlawful behaviour of spatial-building inspectors.
In the letter, the Prime Minister states:
From the information of the Police Authority (01 No. 050 / 19-28834) of 1 November 2019, it can be concluded that this executive body acted in a lawful, timely and conscientious manner towards the State Prosecutor's Office, which, in line with the Constitution and law, manages all stages of the investigation in these cases.
In addition, it is clear that the Police, through the Herceg Novi Security Centre, Budva Security Centre, Department for the Suppression of Economic Crime, and the management itself, promptly and continuously took all measures and actions so that further police findings and initiated proceedings against the two inspectors can result in their criminal prosecution.
Therefore, the activities of the Police led to the collection of all the necessary facts that were submitted to the State Prosecutor's Office in a timely manner, but unfortunately there was no efficient response from the Prosecutor's Office, which resulted in already evident consequences.
As the data from the information submitted indicate a passive attitude of some state prosecutors from the Basic State Prosecutor's Office in Kotor and the Senior State Prosecutor's Office in Podgorica, I am obliged to inform the Prosecutorial Council about these facts.
Prime Minister Duško Marković concluded his addressing to the Prosecutorial Council by saying that, guided by the constitutional division of power, as the Prime Minister, he is responsible for the lawful and efficient operation of all parts of the executive power, but also politically responsible for the overall state of society, which is impaired by inaction or by delays in other parts of the system, and that ,therefore, he submits to the Prosecutorial Council the Information from the Police Authority for further jurisdiction.
