PM Marković at PMQ: Government carefully considers legitimate expectations of beneficiaries of social benefits for mothers with three children or more

The Government was very careful about what were the legitimate expectations of beneficiaries of social benefits for mothers with three children or more, who had acquired this right under an unconstitutional law, as it is a principle arising from the principle of fairness and and an unconstitutional situation had been transformed into a lawful environment by the Government and Parliament, Prime Minister Duško Marković said in the Parliament earlier today, answering a question by Željka Savković, MP.
"That is precisely why the Government respects the Constitution and encourages the legitimate work of all institutions, and because Montenegro is a state of social justice, we have proposed to the Parliament relevant legislation to mitigate the damage from those ad-hoc legal decisions, which threatened the state to face bankruptcy," said the Prime Minister, adding that by passing the Law on Enforcement of the Constitutional Court's Decision of 19 April 2017 and the Law amending the law on Social and Child Protection, a fairness system was put in place, thus transforming the unconstitutional situation into a lawful environment.
"The Government was very careful about what were the legitimate expectations of the beneficiaries who acquired this right under the unconstitutional law, because it is a principle that stems from the principle of fairness. I would also remind you that almost EUR 86 million went out of the state budget with this unconstitutional law, violating the principles of fairness and non-discrimination," the Prime Minister emphasised, categorically rejecting the claim implying that the Government unconstitutionally deprived the acquired rights of beneficiaries of social benefits for mothers with three children or more, while recalling that the Constitutional Court of Montenegro, as the sole competent authority to decide on the conformity of a law with the Constitution, found that the disputed provisions were not in conformity with the Constitution.
"The Government was obliged to implement the court's decision, and it did so in a responsible and best possible manner, respecting the principles of fairness, equal opportunities for all citizens, as well as the principles of legitimate expectation. The cost of implementing the Constitutional Court's Law on Enforcement of the Decision is over EUR 27 million, while the funds for active employment measures, as an accompanying social measure, amount to EUR 5 million on an annual basis,” PM Marković highlighted.
