RESPONSE: Claim of Metropolitan Amfilohije about Government's withdrawal of so-called law on mothers is incorrect, Government implements Decision of Constitutional Court

Podgorica, Montenegro (29 February 2020) -- Regarding the claim of Metropolitan Amfilohije "that there is a possibility for the Montenegrin authorities to withdraw the Law on Freedom of Religion, as it withdrew the law on mothers," we recall the Metropolitan that the Government did not have such a possibility even then, as it does not have it today, and did not withdraw the so-called law on mothers.

Deciding on the constitutionality of that legal regulation, called the Law on Amendments to the Law on Social and Child Welfare, the Constitutional Court of Montenegro, as the sole authority deciding on the law compliance with the Constitution, noted that some of its provisions were discriminatory and were not in accordance with the Constitution. The Government implemented the Decision of the Constitutional Court, in the legal procedure.

Just as an initiative for the assessment of the law has been launched in this case, the Metropolitanate of Montenegro and the Littoral today has the opportunity to submit an initiative to review the constitutionality and legality of the Law on Freedom of Religion or Belief and the Legal Status of Religious Communities, as Prime Minister Marković suggested to Metropolitan Amfilohije.

The Government will implement any decision of the Constitutional Court, as it has done so far.
