ON INTERNAL ORGANIZATION
AND JOB CLASSIFICATION

Podgorica, November 2005


In accordance with the Art. 37. paragraph 2 of the Law on State Administration (Off. Gazette of RoM No. 38/03), upon the motion the Director of Human Resources Management Authority, the Government of the Republic of Montenegro on its session held on November 10 2005 has determined the:

OF THE
DIRECTORATE FOR PUBLIC WORKS

Article 1

In accordance with the law and regulations passed and based upon the law, this Rulebook defines the internal organization and job classification of the Directorate for Public Works (hereinafter referred to as: Directorate).

I INTERNAL ORGANIZATION

Article 2

The tasks of Advisor to the Director of the Directorate shall be performed outside the organizational units.

The tasks from the defined competence of the Directorate shall be performed in the following organizational units:

1. Sector for Investment Projects Realization

Consisting of:

- Department for Pre-Investment Affairs
- Department for Primary Infrastructure
- Department for Building Construction

2. Sector for Investments

Consisting of:

- Department for Economic Efficiency of Investments
- Department for Monitoring of Legislation Implementation

3. General Service Department

Article 3

1. In the Sector for Investment Projects Realization:

Primary infrastructure tasks shall be performed: construction, reconstruction and modernization of city traffic arteries and local lanes in the field of communal infrastructure of hydro-technical and electrical engineering facilities and in the field of building construction: construction of health care facilities, social welfare facilities, facilities for the process of education and upbringing, culture, entertainment, sport and recreation, complexes at the attractive tourist locations and other investments in accordance with the plan and program for social and economic development of Montenegro.
The tasks include preliminary research in the phase of investments preparation: studies, research activities, pre-investment and investment programs, project documentation in the field of primary infrastructure and building construction, and in the phase of investment projects realization: decision making on investments, public bidding process, contracting, construction, plans and programs monitoring, expert supervision (technical and financial part), verification of situations, technical acceptance and final cost calculation for facilities in the field of primary infrastructure and building construction.
The following tasks shall be performed in the Sector: drafting of programs of public works, coordination with governmental working bodies: reports, information, provision of analysis and opinions; and other tasks in accordance with regulations.

a) In the Department for Pre-Investment Affairs:

The tasks which include all operations in the phase of investment proposal preparation shall be performed: terrain recognition, geodesic blueprints, studies and analysis, pre-investment and investment programs drafting and general solution, investment and technical documentation drafting designing, implementation of the procedure of granting construction license, setting up and organization of construction site, ensuring access and placement conditions of work; preparation of project documentation for public bidding; approval of the preliminary project plan, project plan and final preparation of project through the activities of pre-investment commission; the tasks are related to the phase of investment construction preparation for both investments in the field of primary infrastructure and building construction; other relevant tasks in accordance with the regulations.

b) In the Department for Primary Infrastructure:

The tasks relating to the preliminary and preparatory works shall be performed: studies, research activities, pre-investment and investment programs (technical part), project documentation in the field of primary infrastructure including communal infrastructure; investments realization: decision making on investments, public bidding process, contracting, construction, plans and programs monitoring, expert supervision (technical and financial part) with verification of situations, technical acceptance of constructions and final cost calculation on construction, reconstruction and modernization of city traffic arteries, local lanes, hydro-technical and electrical engineering facilities in the field of communal infrastructure and other tasks.

c) In the Department for Building Construction

The tasks relating to the preliminary and preparatory works shall be performed: studies, research activities, pre-investment and investment programs (technical part), project documentation in the field of building construction; tasks on investments realization: decision making on investments, process of public bidding, contracting, construction, reconstruction and adaptation; plans and programs monitoring, expert supervision (technical and financial part): quality control of implemented works, installed materials and equipment, verification of situations, technical acceptance of constructions and final cost calculation for facilities of building construction: health care and social welfare facilities, facilities for the process of education and upbringing, culture, entertainment, sport and recreation, complexes at the attractive tourist locations; and other tasks in accordance with the regulations.

Article 4

2. In the Sector for Investments

The tasks relating to the preparatory works in the phase of preparation of investment proposal shall be performed: studies economic part, investment programs and revision of investment programs, and tasks in the phase of investments realization: decision making on projects realization and investments in the primary infrastructure and building construction; public procurements; tasks on expropriation and property rights issues; contracts on construction and other contracts; representation of the Directorate as a legal entity; work on reports and information in various forms: documents, announcements, etc; drafting of programs for public works; cooperation with internal and external auditors regarding financial enquiry and harmonization with financial principles; control of status in relation with all construction contracts in the field of primary infrastructure and building construction; coordination with governmental working bodies and other tasks in accordance with the regulations.

a) In the Department for Economical Efficiency of Investments

The tasks which are of importance in the phase of investment proposal preparation shall be performed: quality valuation of investment projects including assessment of necessary fund for investment with a number of alternatives and each justified separately, investment programs revision and giving expert appraisal on documentation related to decision making on investments, and in the phase of investments realization: tasks on decision making on investments, public work programs and other investments in the field of primary infrastructure and building construction: tasks related to investment funds from the budget, bank loans as well as possible investment resources, foreign capital; status monitoring of construction contracts and other contracts; control of situations (financial part), coordination with the Ministry of Finance, a competent ministry, and other governmental working bodies, as well as other tasks in accordance with the regulations.

b) In the Department for Monitoring of Legislation Implementation:

The tasks in the phase of investments realizations shall be performed: preparation of tender documentation in the public bidding process including public bidding invitations, opening and valuation of offers and selection of the most favourable bidder public procurements; tasks related to expropriations and property rights issues; work on construction contracts and other contracts which are separately regulated by the law due to their importance; tasks on representation of the Directorate as a legal entity; coordination with the Ministry of Justice, competent ministry, and other governmental working bodies, as well as other tasks in accordance with the regulations.

Article 5

3. In the General Service Department

Various activities shall be performed: preparation of normative act drafts in the field of human resources function upon the motion of the Human Resources Management Authority; implementation of human resources decisions, provisions and procedures with the purpose of expert, professional development of employees, depending on needs and possibilities of the Directorate; expert and administrative affairs, preparation and drafting of separate acts rulebooks, record keeping on rights and obligations of employees: status files, records on annual leaves, decisions; cooperation with the PDI Fund, Health Fund, Montenegrin Employment Agency, cash flow, office work: archiving, especially archiving of investment and technical documentation, typing, photocopying, courier and other tasks in accordance with the regulations.
