ADDENDUM 2
Minutes of Pretender Meeting
In accordance with the Invitation to Tender No 05-57/06 and Tender Documents, the Pretender Meeting for works on construction and commissioning of the Primary school in Podgorica took place on December 18th 2006 at 12 o'clock.
Upon the Promoter compiled Power of Attorney of each present Tenderer and made relevant introductory line, the Tenderers raised the issues herein replied to by the Promoter.

Question 1: How will the constructions of the tendered buildings be financed?
Answer 1: The works are financed by virtue of a credit line in accordance with the Agreement signed between the Government of the Republic of Hungary and the Government of the Republic of Montenegro, through Eximbank, Hungary.
Payment will be made in accordance with the Tender Documents by means of interim monthly payment certificates verified by the Promoter.
Question 2: Please precise currently effective Public Procurement in force in Montenegro
Answer 2: The Public Procurement Law announced in the Official Journal of the Republic of Montenegro No 46 as of July 21st 2006 is presently in force in Montenegro.
Text of the effective Public Procurement Law is available at the website of the Directorate for Public Works www.djr.vlada.cg.yu and the website of the Committee for Management of the Public Procurement Procedures www.nabavka.vlada.cg.yu
Question 3: Shall the proofs of eligibility of tenderers be submitted in accordance with the effective law or in accordance with the one that was in force at the time of previous tenders (Secondary School of Medicine, Examination Centre and Centre for Vocational Education etc.)?
Answer 3: The present tender for construction of the Primary School in Podgorica has been announced in accordance with the Public Procurement Law announced in the Official Journal of the Republic of Montenegro No 46 as of July 21st 2006, while the previously effective Public Procurement Law is no longer in force.
Tenderers are to submit the proof of eligibility in accordance with the Public Procurement Law announced in the Official Journal of the Republic of Montenegro No 46 as of July 21st 2006, Invitation to tender and Tender Documents (Book I, Book II and Book III).
Question 4: Is it possible to receive tender documents in a part related to the Bill of Quantities (Book III) in an electronic form?
Answer 4: Required tender documents will be submitted to all tenderers having purchased the tender document and to those that are to purchase it in the electronic form
Question 5: Which is the applicable contract model?
Answer 5: Invitation to Tender and Tender Documents (Book I), chapter 4, Contract Conditions clearly defines the Contract is unit-price based.
Question 6: Please explain the construction licence validation procedure in Montenegro?
Answer 6: Chamber of Engineers of Montenegro is in charge for validation of any license.

Question 7: IS it necessary to provide the Power of Attorney for Tenderers representative?
Answer 7: Tender documents, Book II.1. states the Tenderer is to provide Power of Attorney for it representative who will attend the Tender Opening which the very representative is to present at the Tender Opening Session.
