Statement of Deputy Prime Minister and Minister of Finance, Igor Luksic PhD, regarding the Proposal of the Law on State-Owned Property

This proposal will be forwarded to the Parliament, with the request to convene the meeting as soon as possible and to have this Law on the Agenda by the end of February. It is very important to do it, because by doing so we will come to the very end of the transition process in Montenegro. The deadlines are also harmonized with the solutions from the Law on Concessions. Disposition of the State-owned property is a supreme right that envisages also the sale, exchange, awarding of concessions, and long-term lease. The upper limit that the Governments approval is asked for is 150 million euros. If the concession is given for the period of 15, 20 or 30 years, and if the value exceeds 150 million euros, then the approval of the Parliament is needed. In all property-related laws, we have established a balance between the competency of the Government and the Parliament. The Proposal of this Law creates the conditions for certain procedures that have already been initiated or the procedures that will be finalized later on to be finalized in the manner that is interesting for investors. It is estimated that a 90-year deadline is a good-quality offer, and there is a possibility to change a treatment of a part of locations that are regularly used, such as villas and land. At this moment, we are offering solutions that should keep a high level of attractiveness of the Montenegrin offering to foreign investors. If their reactions are negative ones, we will reconsider the legal solutions adopted by the Government. This Law defines also the use of the following locations: Velika plaža, Valdanos, Ostrvo cvijeća, Luštice..
