Announcement of The Directorate of Public Works

Following resolution of the Government of the Republic of Montenegro, the Directorate of Public Works under implementation of the infrastructural projects commits to take all necessary activities towards construction and commissioning of the facilities stated hereunder in Podgorica the capital of the Republic of Montenegro:
- School of Medicine
- Institute of Education, Education Testing Centre and Professional Education Centre
- Nursery School
- Elementary School
Financial sources - loan proceeds provided by the Government of the republic of Hungary in conformity with the Agreement signed between the Government of Montenegro and the Government of Hungary.
Public procurement procedure involves:
- Constitution of the Ad Hoc Project Management Unit,
- Preparation of Tender Documents
- Invitation to Tender
- Purchase of Tender Documents
- Providing information on the concerned tenders to any potential tenderer
- Public Tender Opening
- Tender Evaluation
- Contract Award to the successful tenderer
The Directorate of Public Works will announce Invitation to Tender according Article 2 of the Public Procurement Law, following method of the limited competitive bidding, in all as for Article 7 of the aforesaid Law. The tender is open to all companies having head office in the Republic of Hungary.

Invitations to Tenders will be announced on the web site of the Public Procurement Department nabavka.vlada.cg.yu, in daily newspapers distributed throughout the Republic of Montenegro and in one daily newspaper published in the Republic of Hungary.
Subject to prior approval of the Public Procurements Department and with a view to the prompt implementation of the concerned projects, the period of 35 (thirty five) calendar days after the Notice publication date is allocated to the tender preparation. We deem the allocated period reasonable time for the tender preparation.
Pursuant to the article 21 of the Public Procurement Law, the Invitations to Tenders are to be announced by lots meaning two Invitations to Tenders involving two lots each.
In the light of this, the first Invitation refers to an Open Competitive Bidding for Construction and Commissioning of:
- Lot 1 School of Medicine
- Lot 2 Institute of Education, Education Testing Centre and Professional
Education Centre
While the second Invitation refers an Open Competitive Bidding for Construction and Commissioning of:
- Lot 1 Nursery School
- Lot 2 Elementary School
As specified in the Invitation to Tender, tender documents will be purchased for each specific lot separately, with the purchaser clearly indicating the tender documents of interest.
Tender Submission:
1) Participating supplier may submit tender for one lot only,
2) Participating supplier may submit tender for both lots
Each lot shall form a separate contract.
Invitations to Tenders shall specify tender submission deadline for Lot 1 and Lot 2 respectively. These tenders will be opened and evaluated simultaneously, yet treating each lot separately.
Upon publication of the Invitation to Tender, any interested tenderer may purchase tender documents during every working day in the premises of the Directorate of Public Works from 08.00 am to 04.00 pm local time.
Tender Documents comprise three respective volumes for each facility.
Volume I Tender Proposal, Instructions to Tenderers and Conditions and Terms of Contract
Volume II Required Documents according to the Invitation to Tender and PJN 4 of the Public Procurement Law.
Volume III Bill of Quantity
Tenderer shall submit all three the above stated volumes as specified in Tender Documents.
Tender Documents along with the evidence of eligibility (evidence of eligibility is to be submitted in Volume II) shall be translated into English by a certified court interpreter, otherwise a tender shall be rejected and shall not be subject to further consideration.
Tenderer may participate in the Open Competitive Bidding individually or appear as a joint venture. For detail see Invitation to Tender and Tender Documents (Volume I).
Each tender shall be accompanied with the Tender Guarantee in the currency EURO, to the amount equivalent to 2% of the tender value per each lot, as defined in the Instructions to Tenders (Volume I).
Tenderer shall provide Licence (or some other certificate) for construction of the concerned facilities issued by authorized institutions of a State or a Republic wherein the tenderer is registered. The successful tenderer shall validate the Licence with the Chamber of Engineers of the Republic of Montenegro.
Scope of the Contract shall comprise all items of works based on the Bill of Quantity (Volume III) with the proposed unit prices.
Tender unit prices and total price shall include all taxes, duties, fees and other levies payable by the Contractor in conformity with the Contract.
Tenderer shall state unit prices in EURO.
Upon tender opening, Employer will proceed with evaluation and comparison of substantially responsive tenders only.
During evaluation and comparison of the compliant tenders no other method or criterion than those stated in the Invitation to Tender and Tender Documents shall be used. Qualification criteria.
After completion of tender evaluation and award notification, the Contract will be entered with the successful tenderer under provision that each Lot shall form a separate Contract.
In case the tenderer is not registered in the Republic of Montenegro but is a foreign company operating through the local subsidiary, the tenderer shall coordinate its business operations with the local Law on Public Companies.
