III. DOCUMENT ACCESS PROCEDURE
1. Startup Procedure
- To apply for information you should fill il the written request form
- The request form is charge free
- The request form should comprise:
- General information on the requested document (document title, approximate time period of the document)
- Means of access to the document
- Applicant information (first and last name, address or residence, company name and address), or its authorized agent, representative or assignee
- Applicant is free to state other information favoring the ease of the document search
- Request may be submitted in the prescribed form or any other form. The request form is available at the file room of the Directorate for Public Works, or at the website of the Directorate.
2. Request submission procedure
- Request form is submitted directly to the file room within working hours, e.g. 8 am to 4 pm
- By mail to the address Directorate for Public Works, Novaka Miloseva 18, 81000 Podgorica
- By fax to the fax number 381 8123 02 28
3. Means of access to the document
Access to the document may be by means of:
- Personal review of the public record, original or photocopy of the document at the file room of the Directorate
- Documents rewriting by the Applicant at the file room
- Rewriting, photocopying or translation of the document by the Directorate and delivery of the transcription, photocopy or translated text to the Applicant personally or by mail.
4. Request processing and legal protection
- Access to information request form is subject to processing within 8 days as of the submission date, save the cases of the human life and freedom protection when the processing period lasts 48 hours
- In case the voluminous scope of requested documents or when the requested record assumes searching for number of documents thus hindering regular operations in the prescribed deadline, then the deadline for passing and forwarding of the decision may be extended to not more than 15 days
- In case of incomplete or unintelligible request form, the applicant will be requested and instructed to amend the request form within eight days as of the date of receipt of this notice. If the Applicant fails to amend the request form within the prescribed deadline, this request shall not be subject to further consideration. This outcome will be pointed out to the Applicant in the notice on the request amendment. In this case, the request procession period starts with the date of the delivery of the amended request.
- Denied access to information decree contains explanation and reasons for limited access to the document
- Allowed access to information decree referring to the whole document or just a part of it thereof contains method and date for access to the document and the pertaining procedure expenses
- Applicant may raise claim against conclusions and decrees of the Directorate for Public Works to the Ministry of Environmental Protection and Urban Planning within eight days as of the date of the decree receipt.
- Access to information is realized within three days as of the date of the allowed access decree and upon the settlement of the procedure expenses
5. Procedure expenses
- Procedure expenses are attributed to the Applicant
- Procedure expenses refer to the really incurred expenses for rewriting, copying, translation and delivery of the requested document.
- Procedure expenses are paid before execution of the decree
- Disabled persons are free of the procedure expenses
- Procedure expenses are paid to the beneficiary Budget of the Republic of Montenegro Account No. 907-0000000083001-19
