Notice of the Ministry of Finance: the Law on Improvement of the Business Environment became Effective

The Law on Improvement of the Business Environment, adopted by the Parliament upon the proposal of the Government, based on the initiative of the Council for Regulatory Reform and Improvement of the Business Environment, became effective yesterday.
The Law on Improvement of the Business Environment is an efficient “legal tool”, so called omnibus law, which amends i.e. deletes provisions of specific laws in fast and efficient manner in order to create prerequisites for ease of doing business. Anent, the Law contains provisions concerning the amendments or deletion of provisions of specific laws governing the procedure of renewing the registration of business organisations, abolishing specific fees, reduction of administrative and court fees for hiring of foreign workers and certification of sale-and-purchase contracts, reduction of timeframes for proceedings of state authorities concerning electronic communications and environmental impact assessments, as well as improvement of the procedure for registration of immovable property.
The amendments to the Law on Cinematography have abolished the cinematographic fees in order to reduce the burden for business organisations and enabling investments into new technologies aimed at overcoming obstacles to development of business. The amendments to the Law on Court Fees, aimed at reducing unjustified administrative burden, have introduced changes as to the equal fees being introduced for certification of signatures on all newly entered contracts or for extension of the validity of existing contracts. The amendments to the Law on Administrative Fees have reduced significantly the fees concerning temporary residence, issuing of personal and work permits for foreigners. The amendments to the Law on Electronic Communications are only dealing with reduction of deadlines for acting upon requests of interested entities, and are aimed at facilitating business operation in this field.
The process of proposing such regulation required a consultative process with all sectors of the Government as it was necessary to accommodate such legal mechanism within the overall legal system of Montenegro. This is even more the case as such mechanism was not common and practice in our legal system.
The initiative for adoption of the Law is a result of cooperation of representatives of the Government and private sector through the work of the Council for Regulatory Reform and Improvement of the Business Environment.
Whilst the representatives of the International Financial Cooperation – IFC, part of the World Bank group, have especially supported the adoption of this type of regulation, and the representatives of the European Commission have supported the adoption of this Law.
