EU-Montenegro PAR Special Group 2021 – Operational Conclusions

  • Following public consultation, Montenegro will adopt a credible PAR Strategy for the period 2022-2026 and start its implementation according to the 2022 action plan. The new PAR Strategy will have the full list of involved institutions in annex.  Montenegro will establish co-ordination mechanisms supporting its implementation including all relevant stakeholders. 
  • The new PAR Strategy will be fully linked to the budgetary process and reflected in the programme budgeting structure for year 2022.  
  • MPADSM will ensure full implementation of the compliance mechanism for the consultation requirements stated in the Decree on public consultation by reviewing all draft laws and strategies that are submitted to the Government for approval. 
  • Montenegro will ensure that the Register of Institutions is updated according to the latest organisational changes, made available to citizens.
  • When implementing the Law on Civil Servants and State Employees, Montenegro will take steps to focus on merit-based recruitment and avoid any arbitrary dismissals. In particular, Montenegro will provide the following information to the European Commission by the first quarter of 2022:  
  • data on the number of acting senior managers, the duration of their mandates, their belonging to the civil service, etc. A template for the required data will be circulated by the European Commission; 
  • an excerpt from the Personnel Plan for the organisation of open competitions for the vacant managerial posts.  
  • Montenegro will continue with optimization of public administration as an integrated part of the 2022-2026 PAR Strategy.
  • Montenegro commits to improve citizens’ access to public information by adopting amendments to the Law on Access to Information in line with the European and international standards. An action plan will also be implemented and the Agency for Personal Data Protection and Free Access to Information will ensure the implementation of the activities envisaged by the action plan, including steps to reduce the share of successful appeals on requests for information.  
  • Montenegro will continue the process of legislative harmonisation with the Law on General Administrative Procedures. In parallel, Montenegro will start monitoring harmonisation of secondary legislation, in view of a general simplification of administrative procedures, especially those linked to inter-operability of registers and e-services.
