Public bailiffs have started they service today
Public bailiffs, as a new
legal profession in Montenegro, have started their service today, as determined
by the Decision of Deputy Prime Minister and Justice Minister Dusko Markovic.
Thirteen public bailiffs, who previously laid oath, have started service in the
fields of basic courts in Podgorica, Berane, Herceg Novi, Kotor, Pljevlja,
Plav, Rozaje and Zabljak.
In a period of two months from the date of the oath, public bailiffs were
obliged to submit evidence to the Ministry of Justice on the fulfillment of the
conditions for the start of service.
Thus, the public bailiffs prepared their premises that meet the prescribed
requirements, provided evidence of the termination of the earlier jobs, as well
as the proof of the conclusion of insurance contracts, the opening of a special
account at the bank, etc. In addition, all public bailiffs deposited the print
of the official seal and verified signature, based on which the Ministry of
Justice issued their official identification.
Public bailiffs will significantly contribute to a more efficient, faster and
shorter procedure of enforcement, relieving the courts of the pressure,
professionally and expertly conducting the enforcement, which ultimately means
to contribute to respect the right to trial within a reasonable time, which is
one of the fundamental rights guaranteed by European Convention for the
Protection of Human Rights and Fundamental Freedoms.
With this arrangement of enforcement, Montenegro leaves the model of judicial
execution, assigning it to the public bailiffs, except in cases of handing of a
child, employee’s return to the work, and other specific actions that can be
performed only by the enforcement debtor, which remains under the jurisdiction
of the court.
Given that there are some fields basic courts for which there were no
candidates for public bailiffs, Minister of Justice issued a Decision on the
determination of public employees for carrying out activities outside the
official area for which they were appointed.
