One of the most important activities of the Secretariat for Legislation is giving opinions on the compliance of the proposed laws and regulations with the Constitution and legal system of Montenegro. The obligation of the drafter of a proposed law or regulation to obtain the opinion of the Secretariat for Legislation is provided for in the Rules of Procedure of the Government of Montenegro. The procedure regarding issuing of opinions on proposed laws and regulations and the process of bringing the proposed laws and regulations in line with the opinion of the Secretariat is regulated in more detail by the Rules of the Procedure of the Government of Montenegro.


Namely, in respect of a proposal for a law, the Secretariat is obliged to inform the drafting authority, or the Government, of its views in writing within 14 days at the latest. As for proposals for other materials the opinion has to be submitted within five days.
