Semiconductor topography

SEMICONDUCTOR TOPOGRAPHY

Semiconductor topography, in the sense of the Law on Protection of Semiconductor Topography ("Official Gazette of Montenegro", No. 75/10, 40/16 and 84/24) shall be a unique set of three-dimensionally connected images for each layer fixed or encoded in any manner a of which the semiconductor is composed.

A semi-conductor shall be a finished product or a semi-finished product intended to perform an electronic function, consisting of a piece of material which includes one or more connected layers composed of integrated elements, of which at least one element is active.

Topography can be protected if it is original. The topography is original if it is the result of the creator's own intellectual effort and which was not known at the time of creation, i.e. was not in use in the semiconductor industry.

If the topography consists of elements that are known in the semiconductor industry, only a combination of such elements can be protected, provided that it meets the prescribed conditions.

Commercial exploitation of semiconductor topography shall mean the production, sale, rental and leasing or other method of commercial distribution of topography or semiconductors produced on the basis of the appropriate topography, except in the case when the use of topography occurs under conditions of confidentiality.

REGISTRATION PROCEDURE

The legal protection of topography is achieved in the administrative procedure led by the Ministry of Economic Development, in accordance with the Law on the Protection of Topography of Semiconductors, while the Rulebook on the detailed content of the application for the entry of topography in the register of topographies and the detailed content of the register of topographies ("Official Gazette of Montenegro", no. 14 /16) modified detailed content of application for topography registration in the Register of Topographies and detailed content of the Register of Topographies.

The procedure for registering topography is initiated by submitting an application to the Ministry of Economic Development for the entry of topography in the Register.

The application shall contain a request for the grant of the right to protection of topography and the attachments thereto.

A request for the grant of the right of topography is filed on Form T-1 and contains:

1. name of topography;

2. data identifying the applicant and to the creator of the topography if the applicant is not the creator;

3. the date of filing the application;

4. the date of the creation of topography if topography has not been commercially exploited or the date on which and the place where topography was commercially exploited anywhere in the world for the first time.

A request for the grant of the right of topography shall be accompanied by the following attachments:

1. description of topography, containing the data defining the electronic function to be performed by the integrated circuit manufactured according to the topography;

2. graphic representation or representation of topography in another appropriate form identifying the topography;

3. sample of the integrated circuit manufactured according to topography for which protection is applied for if the integrated circuit has been commercially exploited;

4. proof of commercial exploitation of topography;

5. declaration of the right to submit an application, if the applicant is not the creator of the topography.

Proof of payment of the administrative fee in the amount of €20,00 is submitted with the application for topography protection. The account for payment of administrative fees is: 832-3161910-97.

A separate application is submitted for each topography.

The application and documentation for topography registration must not be made available to the public until the date of publication of the topography registration, without the consent of the applicant.
