Prime Minister sends letter to the Venice Commission

Resolving open issues through consensus and compliance with international standards  

Prime Minister Milojko Spajić has submitted a request to the European Commission for Democracy through Law – the Venice Commission – seeking an urgent Opinion with recommendations regarding the termination of the mandate of judge Dragana Đuranović of the Constitutional Court of Montenegro. 

In accordance with the Agreement between representatives of the ruling majority (President of PES, Mr. Milojko Spajić) and representatives of the opposition in the Montenegrin Parliament (Danijel Živković – DPS, Damir Šehović – ES, and Adrijan Vuksanović – HGI), signed on 15 March 2025, which is attached hereto, I am submitting this request to the European Commission for Democracy through Law (Venice Commission) to, within its competences, provide responses to the questions posed by representatives of both the government and the opposition, the letter states. 

Recognizing that both government and opposition representatives have certain legal and constitutional concerns regarding this matter, the letter outlines the key questions and arguments presented by both sides. 

Additional documentation will be submitted to the Venice Commission at a later stage to help provide a comprehensive understanding of the issues related to the interpretation of the mentioned norms in both substantive and procedural terms.

In addition to responding to the questions, the signatory parties of the Agreement request the Venice Commission to provide recommendations for resolving any potential uncertainties related to this issue within Montenegro’s constitutional and legal framework.
